DMCA Notice Requirements

Procedures Upon Receipt of DMCA Notice

Upon receipt of a proper DMCA notice, we will:

- Promptly remove or disable access to the allegedly infringing material

- Forward the written notification to the alleged infringer

- Take reasonable steps to notify the user that we have removed or disabled access to the material

Counter-Notification Procedure

If you believe that material you have posted on our Site was removed or disabled by mistake or misidentification, you may file a counter-notification with our designated copyright agent. A counter-notification must include:

1. A physical or electronic signature of the subscriber.

2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

3. A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

4. The subscriber's name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which we may be found, and that the subscriber will accept service of process from the person who provided notification or an agent of such person.

Upon receipt of a proper counter-notification, we will promptly forward a copy to the person who filed the original DMCA notice and will replace the removed material or cease disabling access to it in 10-14 business days, unless we first receive notice from the copyright holder that a legal action has been filed seeking a court order to restrain the subscriber from engaging in infringing activity.

Repeat Infringers

We will, in appropriate circumstances, terminate the accounts of users who are repeat infringers of copyright. We may also, at our discretion, limit access to our Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

No Obligation to Monitor

We have no obligation to monitor our Site for infringing content. However, we reserve the right to remove any content that we believe in good faith may infringe upon the intellectual property rights of others.
